Terms of Service

These Terms of Service ("Terms") govern your use of the Pixflow Studio website at pixflowstudio.ca and any services provided by Pixflow Studio ("we," "us," or "our"). By accessing our website or engaging our services, you agree to these Terms.

1. Services

Pixflow Studio provides web design, web development, hosting, mobile app development, and related digital services to businesses and individuals. The specific scope, deliverables, timeline, and pricing for each project are defined in a separate written agreement or proposal provided to the client.

2. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information required to complete your project
• Respond to requests for feedback, content, or approvals in a timely manner
• Ensure you have the rights to any content, images, or materials you provide to us
• Pay all invoices according to the agreed payment terms

3. Payment Terms

Payment terms are outlined in the project proposal or agreement. Generally:

• A deposit is required before work begins
• Final payment is due before the site is launched or files are delivered
• Hosting and maintenance fees are billed on the agreed schedule (monthly or annually)
• Late payments may result in suspension of services

4. Intellectual Property

Upon receipt of full payment, you own the final deliverables (website files, design assets, etc.) created specifically for your project. Pixflow Studio retains the right to:

• Display completed work in our portfolio
• Use general skills, techniques, and knowledge gained during the project
• Retain ownership of any pre-existing tools, frameworks, or code libraries used in the project

5. Hosting Services

If you use Pixflow Studio's hosting services:

• We will use reasonable efforts to maintain uptime but do not guarantee 100% availability
• You are responsible for keeping your account information up to date
• We reserve the right to suspend hosting for non-payment or violation of acceptable use policies
• You are responsible for maintaining backups of your content

6. Limitation of Liability

Pixflow Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website, including but not limited to loss of revenue, data, or business opportunities. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

7. Revisions & Scope

Project proposals include a defined number of revision rounds. Additional revisions or changes to project scope beyond what is outlined in the agreement may be subject to additional charges, which will be communicated and agreed upon before work proceeds.

8. Termination

Either party may terminate a project with written notice. In the event of termination:

• You are responsible for payment for all work completed up to the termination date
• Deposits are non-refundable unless Pixflow Studio is unable to begin the project
• Completed work will be delivered upon receipt of all outstanding payments

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

10. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
